Traws Pharma Inc's Comment on Competition and Industry Peers

The company operates in the biotechnology and pharmaceutical industries, which are characterized by rapid technological changes and intense competition. Competitors include large and small pharmaceutical and biotechnology companies, as well as public and private universities and research organizations. Many competitors are multinational organizations developing or marketing pharmaceuticals targeting viruses, oncology indications, or cellular pathways. These competitors typically possess greater financial, technical, and human resources, along with more experience in product discovery, development, regulatory approvals, and commercialization. The company expects competition to intensify as new drugs and advanced technologies emerge. Various drugs are currently approved for the treatment of influenza, including neuraminidase inhibitors, with related patents listed in the FDA's Orange Book. These listings can be utilized by competitors to support abbreviated new drug applications or 505(b)(2) applications. The Orange Book Transparency Act of 2020 codified FDA practices regarding patent listings, and in 2023, the Federal Trade Commission sent letters to several companies concerning anticompetitive conduct related to patent listings.
