Adial Pharmaceuticals Inc 's Comment on Competition and Industry Peers
The company holds an exclusive worldwide license to three patent families covering the use of ondansetron to treat four specified genotypes for alcohol use disorder (AUD), with patent protection expected through 2031. A new patent filed in 2025, owned by Adial, may extend protection to 2045. The low dose of ondansetron used in AD04 (0.33 mg) has not been previously approved. The company asserts that its patents will protect against competitors marketing similar low doses. Off-label use of existing ondansetron products such as Zofran® (4 mg and 8 mg tablets) is considered unlikely to affect AD04 sales due to dosing impracticalities and safety concerns. The company believes its patent protection is sufficient to prevent competitors from launching generic versions of AD04, as marketing the AD04 dose would infringe on their patents. While competitors could theoretically avoid infringement by conducting separate clinical trials for different indications, no such programs are currently known, rendering this risk negligible.
