The Coinbase Custodian acts as the custodian for the Trust's HBAR assets, holding them in a separate, segregated account under the Trust's name. The custodian has agreed not to lend, pledge, hypothecate, or rehypothecate the Trust's HBAR and provides confirmation or access to information to verify the holdings. Coinbase Global, Inc., the parent company of Coinbase Custodian, maintains a commercial crime insurance policy covering client assets held by Coinbase Global and its subsidiaries, including Coinbase Custodian. This insurance is shared among all Coinbase Global customers and is not specific to the Trust or HBAR holders. The Coinbase Custodian may determine whether to support branches of the Hedera Network in the event of a fork but is not responsible for supporting airdrops. The Trust disclaims all rights to Incidental Rights and IR Virtual Currencies. The Coinbase Custodian's liability under the agreement is limited except in cases of fraud or willful misconduct.
