Neither the Trust nor the Funds are required to be members of the NFA. The regulations apply to persons registered with the CFTC or members of the NFA; however, such registrations do not imply approval or endorsement by these entities. The markets covered include commodity interest markets such as agricultural, energy, and metal-based commodity futures contracts, options on these futures contracts, and both cleared and uncleared swaps. The Dodd-Frank Wall Street Reform and Consumer Protection Act imposes requirements on swap market participants, swap dealers, and major swap participants, including position limits, registration, recordkeeping, capital and margin requirements, transaction reporting, and mandatory use of clearinghouses for standardized swaps. These regulations are designed to reduce systemic risks and enhance customer protections, risk management, and regulatory oversight in the securities and commodities markets.
