Tennessee Valley Authority's Comment on Sales, Marketing and Customers
Tennessee Valley Authority (TVA) serves local power company customers (LPCs) that distribute TVA power within a designated service area defined by the "fence" provision, which restricts TVA's sales activities to this area. TVA owns approximately one megawatt of nameplate capacity across nine solar installations located in Tennessee, Alabama, and Mississippi. Under the Federal Power Act, an "anti-cherrypicking" provision safeguards TVA's ability to sell power within its service area by preventing the Federal Energy Regulatory Commission (FERC) from requiring TVA to provide transmission access to other providers delivering power to customers within TVA's territory. This provision reduces the risk of customer loss for TVA, although its protection may be limited or removed by future federal legislation.
